Federal law prohibits employers to discriminate against the employees on the bases of age, gender, marital status, sexual orientation, disabilities, national origin, color or religion. Any question asked to find out any of these details is illegal. Do not react angrily to these questions. Many times the employer may not realize that they are asking an illegal question. Or sometimes they become comfortable talking with you and lose their guard. Handle these questions politely but firmly. You may choose to answer or not to answer these questions. Or you may ask for the relevance of the question in relation to the job and answer their concerns directly. Following are the few examples.
Q: How old are you? When were you born? What is your age?
The employer has the right to know if you are above 18 year of age or not and nothing more than that. So you can assure him that you are more than 18 years of age without divulging your age.
